Article 370 Revoke: What are the Changes in J&K?

The controversial Article 370, which gave the state of Jammu & Kashmir a special autonomy, was revoked on 5th August 2019 after 70 years of its implementation. The latest BJP manifesto mentioned the removal of Article 370 as one of its top priorities in May-June address.

According to Home Minister Amit Shah, this revoke was primarily meant to decimate the influx of terrorism into the state and the country, owing to its religious dispute and also bring the state at par with the rest of the country. Following the abrogation, the regions of Jammu & Kashmir and Ladakh will now be categorized as Union Territories.

The Palpable Changes

Here are some impactful changes that took place post the revoke and its implications.

J& K Constitution Scrapped

Before Revoke: Jammu & Kashmir had access to its own constitution and laws that made it not answerable to the central government, save for a few financial, security and communication affairs.

Post Revoke: Jammu & Kashmir is now under the common Indian constitution with no special rules.

Indians Can Buy Property

Before Revoke: Thanks to the state governed regulations, non-residents or those who married outside the region were not allowed to buy or sell property on the Kashmiri land.

Post Revoke: Any Indian citizen will be able to buy or sell property in the state. This can hopefully give rise to industrialization in the region.

Union Territory

Before Revoke: Jammu & Kashmir was a state with special status, following its own laws and legislation.

Post Revoke: Jammu & Kashmir is now a Union Territory along with Ladakh and will be under the leadership of the Central Government.

Dual Citizenship

Before Revoke: The residents of Jammu & Kashmir were given one separate entity by the state and another by the Central Government. That gave them the right to hold dual citizenships.

Post Revoke: Since Jammu & Kashmir is now a Union Territory under the patron of the Central Government which slots them under a single citizenship like the rest of the fellow Indian citizens .

Separate Flag

Before Revoke: J&K had two different flags, one identifying with the state and one with India.

Post Revoke: There is no separate flag for the state.

RTI Application

Before Revoke: As per the state regulation, the residents and citizens did not have the flexibility to use their Right To Information.

Post Revoke: Now that the state is under the Central Government, like in other states, the citizens of J&K can exercise their Right to Information.

CRPC in, RPC out

Before Revoke: The residents of J&K had separate laws for fundamental rights, citizenship and ownership of property.

Post Revoke: There will be no more special regulations for the state’s citizenship. Central Penal Code will enter the union and Ranbir Penal Code will be done away with.


The decision received a mix of reactions with some calling it an action long overdue while some consider it to be undemocratic and needs to be reprimanded.
